Private legal practitioner, Lawyer Ralph Kwame Agyapong, has advised the Privileges Committee members to serve an invitation letter to Adwoa Safo via whatsapp or tiktok.
The Committee extended an invitation to the Dome Kwabenya Member of Parliament (MP) who doubles as the Minister for Gender, Children and Social Protection to appear before them on Tuesday 14th June, 2022 to explain her 15 days absence of parliamentary sitting as directed by the Constitution. Hon Adwoa Safo however, failed to respond to the call with the excuse that she is not aware she has been summoned before the committee.
The committee is said to publish the invitation in the dailies and if she fails to appear before them, they will go ahead and take further action.
Lawyer Agyapong while speaking on the Dome Kwabenya MP’s brouhaha on Movement TV said, ‘’if you take a person to court and you can’t find them to serve them their invitation letter after the third attempt, you go back to the court and fill a form called affidavit of non-service, a legal statement that shows that the person was not able to serve a legal document. And your lawyer will present an Ex-parte motion and attach the affidavit. Your lawyer will make a request from the court for an order to extend an invitation to the person at home, either by pasting on their wall or giving it to anyone in the house who is above 18 years, or it can also be pasted on the notice board at the High Court’’.
He further added that they can go ahead to invite her through the dailies but they should target a particular one that she is fond of reading.
‘’In recent times, you can serve the person via whatsapp and once it ticks blue it automatically indicates the person has read it meaning she has been served or they can use any social media platform that the person is noted to use and in this case since she has been spotted on tiktok on some occasions the committee can take advantage’’, he stated.
Lawyer Agyapong indicted that If she refuses to appear the law, the committee can continue the process and take action without her presence.
“They should use the 4th channel’’, he advised.
