Parliament Can’t Declare Assin North Seat Vacant Until The Court Appeal Is Over- Lawyer John Darko (VIDEO)

A private legal practitioner and lecturer at the Ghana Institute of Management and Public Administration (GIMPA), Lawyer John Darko, had said that parliament cannot declare the Assin North seat vacant until the court appeal is over.

Speaking on Movement In The Morning with Nana Oheneba Asiedu, he indicated that the Member of Parliament  was injuncted by the court making his position as a parliamentarian illegal.

“Hon James Gyakye Quayson’s continues going to parliament was a violation against the constitution although he had  appealed to the court. The law did not regard him as a member of parliament’’, he said.

He stressed that the New Democratic Congress(NDC) must fasten the appeal process so the court will give parliament the chance to declare the seat available, to give room for a new representation for Assin North constituency.

Lawyer Darko added that parliament can declare the seat vacant after twenty-one days of the court appeal ruling after which Hon Quayson can re-contest for the seat.
