Private legal practitioner, Lawyer William Kusi, has said that the court cannot put an injunction on the Electronic Transfer Levy Act, 2022 (Acts 1075) that was passed by parliament on Tuesday 29th March, 2022.
“Parliament has a role to play, similarly the court has its role. Both parties do not interfere in each other’s dealings. E-levy was implemented by parliament, and that is the business of government, the court cannot stop it from running”, he said in a telephone interview on Movement TV.
The minority members of parliament led by the minority leader, Haruna Iddrisu, Mahama Ayariga, and Samuel Okudzeto Ablakwa filed a suit at the supreme court against the implementation of the electronic levy (e-levy), alleging that the decision was taken without the requisite quorum in article 104, clause 1 of the 1992 constitution, after minority members walked out of parliament before the bill was considered.
The electronic tax law is set to be implemented on the 1st of May, 2022; however the court hearing on the filed suit by minority members of parliament is set for 4th May, 2022.
